Residence permit for an intra-corporate transfer

An Intra-Corporate Transfer (ICT) residence permit is a special type of residence permit designed for executives, specialists and trainees who are temporarily transferred by international companies to their Spanish branches. This procedure, established under Law 14/2013 ‘On Support for Entrepreneurs’, helps to avoid bureaucratic delays, as the entire process is prioritised through the UGE-CE. As a result, a decision on your application is made in just 20 working days, making this residence permit one of the fastest and most reliable.

Who is it suitable for?
This residence permit is intended for non-EU nationals who are transferred to work in Spain within the same company or group of companies. Categories of employees:
Managers (Directivos): Employees in managerial positions.
Specialists (Especialistas): Employees with unique expertise required for the company’s operations in Spain.
Trainees (Trabajadores en formación): University graduates undertaking a professional development programme with a view to securing a key role within the company.
Key legislation
    • Law 14/2013 "On Support for Entrepreneurs and Their Internationalisation". This law provides a special, fast-track procedure for categories of foreign nationals deemed strategically important to the economy, including intra-corporate transferees.
    • EU Directive 2014/66/EU (ICT-EU): This type of permit allows an employee who has been granted a residence permit in Spain to move freely and work in other EU countries (subject to certain conditions).
Requirements
Requirements are imposed on both the company and the employee themselves, confirming the validity and necessity of the transfer.
1. Requirements for the company/group of companies:
  • It is necessary to demonstrate genuine and continuous business activity both abroad and in Spain.
  • The Spanish subsidiary must be part of the same group of companies as the parent company.
2. Requirements for the employee:
  • Work experience: You must have been in continuous employment with the sending company (or one of the group companies) for at least three months prior to submitting your application.
  • For managers and specialists: Hold a higher education qualification or have at least three years’ proven professional experience in the relevant field.
  • For interns: Hold a higher education qualification and be enrolled in an official internship programme.
  • No criminal convictions in Spain or in the countries of residence over the past 5 years.
  • Comprehensive health insurance in Spain (if not covered by the Spanish social security system).
Required documents
(main list)
A declaration (Form MI-T) signed by the company.
A full copy of the employee’s passport.
Documents confirming the existence of the group of companies and its actual business activities (e.g. extracts from registers).
Documents confirming the employee’s employment relationship with the sending company (e.g. employment contract and certificate of service).
An official transfer letter (carta de traslado) from the company, stating the position, salary, duration and terms of the transfer to Spain.
Employee CV.
A degree certificate (with an apostille and translation) or documents confirming three years’ work experience.
Certificate of good conduct (with an apostille and a certified translation).
Receipt for payment of stamp duty.

Application procedure

The process is initiated by the Spanish subsidiary and is completed very quickly. The employee’s family can submit their applications at the same time.
  • Submitting an application to UGE-CE:

    The company’s Spanish office submits the full set of documents online via the UGE-CE electronic platform.
  • Fast-track processing:

    The processing time for the application is 20 working days. If no response is received, the application is deemed to have been approved under the principle of ‘administrative silence’.
  • Obtaining a visa (if you are outside Spain):

    Once your application has been approved, you should submit your visa application to the Spanish Consulate. The processing time for the visa is 10 working days.
  • Applying from Spain (if you are in the country legally):

    You can apply for this residence permit whilst already in Spain, and apply for the card immediately after it has been approved.
  • Applying for a Resident Card (TIE):

    Upon arrival in Spain (or following approval within the country), you must register with the police within one month to have your fingerprints taken. The initial residence card is valid for three years.
