The Digital Nomad's Residence Permit

The Digital Nomad Residence Permit is a special residence and remote work permit introduced by Spanish legislation to attract professionals who can work regardless of their physical location. This residence permit allows you to live legally in Spain whilst continuing to work for overseas companies or clients, and to benefit from an attractive special tax regime.

Who is it suitable for?
This residence permit is intended for non-EU nationals who:
Employees: Working remotely for a company registered outside Spain.
Freelancers and sole traders: You have clients based outside Spain. Income from Spanish clients must not exceed 20% of your total income.
They have a stable monthly income sufficient to live in Spain.
Key legislation
    • Law 28/2022 "On the Development of the Start-up Ecosystem", which introduced this category of residence permit for the first time.
    • Law 14/2013 "On support for entrepreneurs and their internationalisation", which provides for an accelerated processing procedure through the UGE-CE unit.
Requirements
The key requirements relate to your income and proof of remote employment.
Professional status:
  • For employees: An employment contract with a foreign company (valid for at least three months) and written permission from the employer to work remotely.
  • For freelancers: Service agreements with clients and proof of continuous employment for at least one year.
Income: You must demonstrate a stable monthly income exceeding 200% of the IPREM (Public Multi-Purpose Income Indicator).
For 2026, the amount is: €2,763 per month.
For families: +€1,036 per spouse and +€345 per child.
Professional qualifications: Hold a higher education qualification or have at least three years’ proven experience in the relevant field.
No criminal convictions in Spain or in the countries where you have lived over the last 5 years.
Health insurance: Take out a private health insurance policy with comprehensive cover, with no excesses or waiting periods.

The applicant’s valid passport.
Documents confirming remote working (employment contract, letter from the company, contracts with clients).
Documents proving income (bank statements, invoices, tax returns).
Certificate of good conduct (with an apostille and a certified translation).
Documents confirming qualifications (degree certificate or CV).
Private health insurance policy.
Application procedure
There are two main approaches, and one of them is far more advantageous.
1. Submission via the Consulate:
You submit your application to the Spanish Consulate in your country. If approved, you will be issued with a one-year Type D visa. Once you have entered Spain, you must apply for a residence card (TIE) within three months; this will be valid for three years.
2. Application in Spain (residence permit):
If you are in Spain legally (for example, on a tourist visa), you can apply directly to UGE-CE. This route allows you to obtain a 3-year residence permit straight away, bypassing the visa stage.
Processing time: 20 working days.
Applying for a TIE card: Once your application has been approved, you must book an appointment with the police to have your fingerprints taken.
