Upgrade from a student residence permit to a work permit with the right to be employed

This procedure enables international students who have successfully completed their studies in Spain and found employment to change their temporary residence status (estancia) to a residence permit with the right to work (residencia y trabajo).

Who is it suitable for?
Non-EU foreign nationals who:
They are in Spain on a student visa (Estancia por Estudios).
They had been in this status for at least six months.
We have received a genuine job offer from a Spanish employer.

Requirements
A residence and work permit is issued for one year.
Have been a student for at least 6 months.
Provide an employment contract guaranteeing continuous employment throughout the year.
The salary must not be less than the statutory minimum wage (SMI) on an annual basis, regardless of whether the contract is for full-time or part-time work.
Working conditions must comply with current legislation and the collective agreement.
No criminal record.

Modification application form (Official Form EX-03).
A copy of your passport.
A copy of the student’s current TIE.
Employment contract (Contrato de trabajo) and job description.
Documents confirming qualifications (diploma or certificate).
Proof of payment of the fee.

Application procedure

  • Gathering documents:

    A complete set of documents, including a valid TIE, a copy of your passport and, crucially, an employment contract from a Spanish employer.
  • Submitting an application:

    Submission of the application (Official Form EX-03) by the employer or their authorised representative to the Foreigners’ Office (Oficina de Extranjería) in the area where the workplace is located.
  • Adherence to deadlines:

    Applications must be submitted 60 days before or within 90 days of the expiry of the student visa. Important: This exemption does not require consideration of the national employment situation.
  • Awaiting a decision:

    Awaiting a decision from the Immigration Office. The official processing time is three months. Note: Once this period has elapsed, the principle of ‘tacit approval’ (silencio positivo) often applies.
  • Obtaining a TIE:

    Once you have received a positive decision (within one month), you must book an appointment with the police (Cita de Huellas) to have your fingerprints taken and collect your new residence card (TIE) with ‘residencia y trabajo’ status.
Change of status — progression to a new level of legalisation.
Procedures for changing residency status, particularly when transitioning from student status or to the UGE-CE scheme, are subject to strict deadlines and rigorous documentation requirements. We guarantee that your application will be submitted to the appropriate authority (Extranjería or UGE-CE) within the stipulated deadlines, in compliance with all the new regulations Royal Decree 1155/2024, which is key to obtaining a positive decision.
