Change of status from "Residence Permit 14/2013 to Residence Permit 4/2000"

This procedure involves a transition from the special regime (Law 14/2013 – for investors, highly qualified professionals and entrepreneurs) to the General Regime (Organic Law 4/2000). This transition is necessary when a resident under Ley 14/2013 no longer meets the specific requirements of that regime (for example, if they lose their highly qualified job but wish to remain in Spain).

Non-EU foreign nationals who:
They currently hold a valid residence permit (or one that has expired by no more than 90 days) under Law 14/2013.
No longer meet (or do not intend to meet) the criteria set out in Law 14/2013.
They meet the requirements for obtaining one of the types of residence permit under the General Scheme (e.g. Non-Work Residence Permit, Residence and Work Permit, etc.).

Requirements
The validity period of the new residence permit will depend on the type of permit selected under the General Scheme (this is often one year for the first non-lucrative permit or two years for a renewal).
Current status: Hold a valid permit under Law 14/2013, or one that has expired by no more than 90 days.
General requirements: Compliance with the general requirements of Organic Law 4/2000 (no criminal convictions, no ban on entry into Spain).
Grounds for a new residence permit: You must provide the grounds and evidence of eligibility for the desired type of residence permit under the General Scheme (for example, proof of sufficient funds for a No Lucrativa permit or an employment contract for a Residencia y Trabajo permit).

Application procedure

  • Definition of the new status:

    A preliminary determination of which specific type of residence permit under the General Scheme will be applied for (Non-Work Permit, Residence and Work Permit, etc.).
  • Preparation of documents:

    Gathering a complete set of documents confirming compliance with the requirements for the new, selected type of residence permit.
  • Submitting an application:

    Submit an application (in person or through a representative, depending on the type of residence permit) to the Foreigners’ Office (Oficina de Extranjería) in your area of residence.
  • Adherence to deadlines:

    Applications must be submitted 60 days before or within 90 days after the expiry of the current residence permit under Law 14/2013.
  • Obtaining a TIE:

    The official processing time is three months.
    Once a positive decision has been received, a new resident card (TIE) will be issued, confirming the holder’s status under the General Scheme.
