Renewal of residence permits for entrepreneurs and their family members

The renewal of the Entrepreneur’s Residence Permit (Autorización de Residencia para Emprendedores) is governed by the Entrepreneurs Act (Law 14/2013) and allows the holder to continue their innovative activities in Spain.

Who is it suitable for?
This extension is intended for non-EU nationals who:
Hold a valid residence permit issued upon the launch of an innovative business project (entrepreneurs).
They are continuing to develop their project, which has been recognised as being of general economic interest to Spain.
They wish to extend this status to themselves and their family members.
Key legislation

Requirements
The key requirement is to demonstrate that the business plan approved when the residence permit was first granted is being implemented and making progress. The permit is renewed for two years.
A report (informe) must be submitted by the Directorate-General for International Trade and Investment (Dirección General de Comercio Internacional e Inversiones), confirming that:
  • The project is still ongoing.
  • Is the economic interest being maintained, or is it growing?
  • The original plan or its revised objectives are being implemented.
Provide evidence of sufficient funds to cover living expenses if your business is not yet generating sufficient income.
No criminal record in Spain.
Family members renew their residence permits together with the main applicant. It must be confirmed that they continue to live together (convivencia familiar).
Required documents
Main list
Renewal application form (Model MI-T for the main applicant, MI-F for families).
A valid passport.
A copy of the current TIE.
A positive report from the Directorate-General for International Trade and Investment on the implementation of the business plan.

Declaration (Declaración Responsable) confirming continued cohabitation with the family (for family members).
Proof of payment of the fee (Form 790, Code 038).

Application procedure

The procedure is handled by the Department for Large Enterprises and Strategic Teams (UGE-CE). The application must be submitted within 60 calendar days before the expiry of the current residence permit or within 90 days after its expiry.
  • Serving:

    Applications must be submitted exclusively online via the UGE-CE electronic register.
  • Consideration:

    The processing time under Law 14/2013 is 20 working days. Failure to receive a response implies approval (silencio administrativo positivo).
  • Obtaining a TIE:

    Once approved, you must apply for a new TIE card at the police station.
