Refugee status is granted to persons who cannot return to their home country due to well-founded fears of persecution on one of five grounds specified in the Geneva Convention (race, religion, nationality, political opinion, or membership in a particular social group).

Who is it suitable for?
Foreign nationals who are not EU citizens and who:
Are outside their country of citizenship.
Have well-founded fears (fundados temores) of becoming victims of persecution.
Primary legislation
  • Law 12/2009 (regulates the right to asylum and subsidiary protection).
    The 1951 Geneva Convention relating to the Status of Refugees.
Requirements
Refugee status is permanent. The resident card (TIE) is renewed every 5 years.
After 5 years of living with this status, it is possible to apply for long-term residency.
Location: The applicant must be in Spain or at the border.
Submission deadline: Applications may be submitted at any time (Law 12/2009, Art. 17.1). However, in order to increase confidence in the validity of the concerns, it is recommended that applications be submitted as soon as possible after arrival.
Justification: Providing the most complete information and evidence possible about persecution or threats in the home country.

Registration procedure

  • Initial contact:

    Submit your asylum application in person at the Foreigners Office (Oficina de Extranjería), police station (Comisaría de Policía), or border post (Puesto Fronterizo).
  • Registration and identification:

    A temporary document confirming the submission of the application (resguardo blanco or "white card") is issued.
  • Formalization of the request:

    A formal interview with an authorized body (often the police) to explain in detail the grounds for the asylum request.
  • Work permit:

    During the first 6 months after submitting the application, there is no right to work. Six months after the interview (if no decision has been made on the case), the applicant is automatically granted the right to work.
  • Receiving a red card:

    Obtaining a red card (Tarjeta Roja) — a temporary document that, after 6 months, gives you the right to work in Spain.
  • Review:

    Awaiting a decision from the Ministry of the Interior (Ministerio del Interior). The review period is not strictly regulated and can range from 6 months to several years.
  • Obtaining a decision:

    Decision on granting Refugee Status (Estatuto de Refugiado) or Subsidiary Protection (Protección Subsidiaria).
