Residence permit for a family member of a Spanish resident

A family reunification residence permit is a key instrument that enables a foreign national already legally residing in Spain (the so-called sponsor — reagrupante) to bring their immediate family members to join them. This type of residence permit demonstrates Spain’s commitment to the principle of family protection and enables family members to live, and subsequently work, in the country legally. The main feature is that the process begins with an application submitted by the resident already in Spain.

Who is it suitable for?
This residence permit is intended for family members of a foreign national who holds a valid temporary residence permit in Spain (having resided in the country for at least one year and having been granted permission to extend their stay for a further year).
The following family members are eligible for family reunification:
Spouse or civil partner (pareja de hecho), whether registered or having confirmed a stable relationship (of at least 12 months’ duration or where there are children in common).
Children of the sponsor or his/her spouse/partner who are under 18 years of age, or who are older but have a disability and require support.
Parents (first-degree ascendants) of the sponsor or their spouse/partner who are financially dependent on them (specific requirements regarding age and dependency must be met, and the sponsor must hold a long-term residence permit (Larga Duración)).
Key legislation
  • Organic Law 4/2000 (Ley Orgánica 4/2000) on the rights and freedoms of foreign nationals in Spain (Articles 16–19).
    Regulations implementing the Act (Royal Decree 1155/2024), Articles 65–68, governing the conditions for the family reunification procedure.
Requirements
The key requirements apply to residents (family reunification applicants) living in Spain:
Residence status: You must have been living in Spain legally for at least one year and hold a residence permit valid for at least another year. (For family reunification, a long-term residence permit (Larga Duración) is required.)
Financial stability: The applicant must demonstrate that they have stable and regular income to support themselves and the family members they are seeking to reunite with. The minimum amount is linked to the IPREM (Public Multi-Purpose Income Indicator):
For two family members (resident + one family member): 150% of the IPREM per month.
For each additional family member: +50% of the IPREM per month.
Suitable accommodation: Provide a Housing Suitability Report (Informe de Adecuación de Vivienda) issued by the relevant authority.
Health insurance: Take out a private health insurance policy (for all family members joining you).
No criminal convictions: The person seeking family reunification must not have any criminal convictions in Spain or in their country of residence over the last 5 years.

Passport (for the resident and the person joining them).
Documents proving family relationship or connection (marriage certificate, birth certificate, civil partnership certificate).
Proof of financial standing (employment contract, bank statements, proof of income).
Housing Fitness Report.
Certificate of good conduct (for adults, with an apostille and a certified translation).
Medical certificate.
Health insurance (for all family members).

Application procedure

The process consists of two main stages:
  • Submitting an application in Spain:

    The sponsor (reagrupante) must submit an application and a full set of documents (excluding the documents of the family member being sponsored, which are submitted as part of the visa application) to the Oficina de Extranjería (Immigration Office) in their place of residence or via the online platform.
  • Consideration:

    The processing time is up to two months. If no decision has been made within this period, the application is deemed to have been rejected by ‘administrative silence’ (silencio administrativo negativo).
  • Application for a D visa:

    If the application is approved, the family member seeking to join the sponsor must apply in person at the Spanish Consulate in their country of residence within two months to obtain a Type D entry visa.
  • Applying for a TIE card:

    Upon entering Spain (on a D visa), the family member joining the sponsor must report to the police within 30 days to have their fingerprints taken and to collect their residence card (TIE).
  • Important: The residence permit issued to the family member joining the sponsor will be valid for the same period as the sponsor’s residence permit (usually 1 year or the remaining period). Upon subsequent renewals, the reunited family member is entitled to work in Spain without the need to apply for a separate permit. After 5 years of residence, the whole family may apply for a long-term residence permit.
