Who is it suitable for?
Non-EU foreign nationals who:
Officially identified as victims of human trafficking (víctimas de trata).
Key legislation
    • Royal Decree 1155/2024 (Articles 148–155).
Requirements
  • Initial residence permit: 1 year.
  • Subsequent renewal: 5 years.
Identification: The existence of an official report (acta) from the police, the public prosecutor’s office or an administrative authority identifying the person as a presumed victim of human trafficking.
Reflection period: The victim is granted a reflection period (período de restablecimiento y reflexión) of at least 90 days.

Victim identification report (acta) issued by the competent authority.
Statement of consent/refusal to cooperate with the authorities.

Application procedure

  • Identification and interpretation:

    Identification of a foreign national as a victim of human trafficking and the provision of a reflection period (minimum 30 days) to decide whether to cooperate.
  • Generating a report:

    Issuing a report on cooperation and the victim’s consent to file a complaint.
  • Submitting an application:

    Submission of the application (Official Form EX-10) by the applicant in person or through their representative.
  • Consideration:

    There is no strict deadline for consideration, but it is treated as a priority due to the nature of the collaboration.
    Consequences of the expiry of the deadline: The principle of ‘administrative silence’ (silencio negativo) applies.
  • Obtaining a permit:

    Obtaining a residence permit with the right to work, valid for 5 years. Important: This status also applies to children and incapacitated relatives.
