 Residence permit for assisting administrative authorities in combating criminal networks (Hoja 36)

A residence permit is granted to victims, affected persons or witnesses who actively cooperate with administrative authorities (not the police or courts) in combating criminal networks (for example, in the areas of illegal immigration or fraud).

Who is it suitable for?
Non-EU foreign nationals who:
They are victims, survivors or witnesses of criminal networks and actively cooperate with the authorities (e.g. immigration services).
Key legislation
  • Royal Decree 1155/2024 (Articles 142, 143, 145–147).
Requirements
Temporary permit: 6 months (for the duration of the collaboration).
Final authorisation: 5 years (following confirmation of cooperation).
Cooperation: An official report (informe) from the relevant administrative authority confirming active and substantial cooperation.
Good character: No criminal record.

Application procedure

  • Collaboration:

    Establishing the fact of active cooperation with administrative bodies (not police or judicial bodies) in the fight against organised networks.

  • Report generation and initiation:

    The issuance by the administrative authority of an official report on cooperation and its submission for the purpose of exoneration and the suspension of the sanctions proceedings.

  • Submitting an application:

    Submission of the application (Official Form EX-10) by the applicant in person or through their representative.

  • Consideration:

    There is no strict deadline for consideration, but it is treated as a priority due to the nature of the collaboration.
    Consequences of the expiry of the deadline: The principle of ‘administrative silence’ (silencio negativo) applies.

  • Obtaining a permanent residence permit:

    If the final decision is positive, you will be granted a residence permit with the right to work, valid for five years.
