Who is it suitable for?
Non-EU foreign nationals who:
Have lived in Spain continuously for at least two years.
Can provide evidence of an employment relationship (whether as an employee or self-employed) for a period of at least six months during this time.

Requirements
A residence and work permit is issued for one year.
Residence: You must prove that you have resided in Spain continuously for at least two years. Absences from Spain must not exceed 90 days in total.
Good character: No criminal convictions in Spain or in countries of previous residence.
Employment history: Provide evidence of employment (including informal work) during the period:
  • 6 months' employment (full-time) or
  • 12 months of employment (part-time) or
  • 6 months of self-employment (autónomo).
Evidence: The employment relationship must be established by a court judgment or an administrative decision (e.g. a report from the Labour Inspectorate).

Residence permit application form (Official Form EX-10).
Proof of two years’ residence (historical registration).
Certificates of good conduct (from the country of origin and previous countries of residence).
A court ruling or a decision by the Labour Inspectorate confirming the employment relationship.

Application procedure

  • Obtaining proof of performance (Critical stage):

    This is the most difficult and essential step. You must obtain official confirmation of any unauthorised employment over the past two years. This may include:
    • A court judgment (sentencia judicial) confirming the employment relationship.
    • An administrative decision (acta de conciliación) or a Labour Inspectorate report (Acta de la Inspección de Trabajo) confirming the existence of an employment relationship.
  • Gathering documents:

    Gather all evidence of your two years’ residence (historical Empadronamiento) and official proof of employment.
  • Submitting an application:

    The application (Official Form EX-10) must be submitted to the Immigration Office (Oficina de Extranjería). Unlike the Arraigo Social application, a contract or job offer is not required at this stage.
  • Processing time:

    The official processing time is three months.
  • Obtaining a TIE:

    Once your application has been approved, you will be issued with a residence permit that includes the right to work, and you will need to apply for a TIE card.
