Residence permit based on long-term residence

"Arraigo Social" (Social Integration) is the most common route to legalisation, based on proof of social integration, which requires a long period of residence, a clean criminal record, and the provision of an employment contract or proof of sufficient financial means.

Who is it suitable for?
Non-EU foreign nationals who:
Have lived in Spain continuously for at least 3 years.
They may provide an employment contract or prove that they have sufficient funds.

Requirements
A residence and work permit is issued for one year.
Residence: You must prove that you have resided in Spain continuously for at least three years. Absences from Spain must not exceed 120 days in total.
Good character: No criminal convictions in Spain or in countries of previous residence.
Links: Provide evidence of social integration (via the Informe de Integración Social issued by the autonomous community or through family ties with residents).
Economic basis: Provide one of the following two options:
Employment contract: For a minimum period of 1 year and with a salary of at least the SMI.
Personal funds: Proof of sufficient funds to cover living expenses if the applicant is not required to work (e.g. is joining a spouse).

Application procedure

  • Path definition:

    Please choose whether you will apply on the basis of an employment contract (the most common route) or by providing proof of family ties with a resident or Spanish national.
  • Preparation of the contract/report:

    If you have no family ties, obtain a Preliminary Social Integration Report (Informe de Integración Social) from your Autonomous Community. This may require an interview and proof of your knowledge of the language and culture.
  • Gathering documents:

    Gather all evidence of three years’ residence (historical Empadronamiento), certificates of good conduct and other documents, including the draft contract.
  • Submitting an application:

    The employer or an authorised representative must submit an application (Official Form EX-10) to the Immigration Office (Oficina de Extranjería).
  • Processing time:

    The official processing time is three months. If no response is received within this period, the application is deemed to have been rejected (silencio negativo).
  • Obtaining a TIE:

    Once you have received a positive decision, you must book a fingerprint appointment to apply for a TIE card.
