Family-based Residency (Arraigo Familiar)

"Arraigo Familiar" (Family Ties) is a residence permit based on the applicant’s family ties with Spanish citizens or other residents. It is one of the quickest routes to legalisation and does not require a long period of residence.

Who is it suitable for?
Non-EU foreign nationals who:
Are the father or mother of a minor Spanish citizen.
They are the support person (persona de apoyo) of an adult Spanish citizen with a disability.
Are the spouse or registered partner (pareja de hecho) of a Spanish citizen.
They are ascendants or descendants of Spanish citizens (in certain cases).

    • Royal Decree 1155/2024 (Article 124.3).
Requirements
A residence and work permit is issued for a period of five years (in the case of a parent, spouse or partner of a Spanish citizen).
Family relationship: Provide proof of family relationship (birth certificate, marriage certificate).
Case 1 (Parent of a Spanish national): To live with a minor who is a Spanish national, to be responsible for their upbringing, and to have the financial means to support them.
Case 3 (Spouse): Provide a marriage certificate or proof of registration as a civil partner with a Spanish citizen.
Good character: No criminal convictions.

Application procedure

  • Preparing documents proving family ties:

    Gather and have all documents confirming your family relationship certified (birth certificate of your Spanish child, marriage certificate or civil partnership certificate with a Spanish national).
  • Gathering general documents:

    Obtain a certificate of good conduct and your passport. For this type of residence permit, you do not need to prove that you have lived in Spain for a long period of time.
  • Submitting an application:

    The application (Official Form EX-10) must be submitted to the Immigration Office (Oficina de Extranjería).
  • Right to work:

    An Arraigo Familiar permit automatically includes the right to work (either as an employee or on a self-employed basis). The official processing time is three months.
  • Obtaining a TIE:

    Following a positive decision, you will be granted a 5-year residence permit and issued with a TIE card, which confirms your right to live and work in the country.
