Permanent residence in Spain after five years of residence

The Permanent Residence Certificate (Certificado de Registro de Ciudadano de la Unión de carácter permanente) confirms the right of an EU/EEA/Swiss citizen to reside and work in Spain indefinitely after five years of continuous legal residence.

Who is it suitable for?
This status is intended for citizens of the European Union (EU), the European Economic Area (EEA) or Switzerland who:
Have lived in Spain legally and continuously for 5 years.
During this period, they had one of the grounds for residence (employment, self-employment, student status or sufficient financial means).
They wish to obtain an official document confirming their right of permanent residence.
Key legislation
  • Royal Decree 240/2007 (Real Decreto 240/2007) of 16 February (Articles 10–11) — regulates the right to permanent residence.
    *For EU citizens, the Certificate of Permanent Residence is valid indefinitely (validez indefinida) and does not need to be renewed.
Requirements
A key requirement is proof of continuous and lawful residence.
Continuous residence: The total period of legal residence in Spain must be at least 5 years.
Permissible absences: Interruptions in residence not exceeding two consecutive years do not affect the right to obtain permanent residence. Short-term absences (holidays) of less than six months per year are not considered interruptions.

A valid passport or national identity card.
Proof of five years’ legal residence (e.g. employment history report, tax returns or bank statements).
Proof of payment of the fee (Form 790): Code 052, section 2.7
Application procedure
The entire process takes place at the Immigration Office (Oficina de Extranjería) or at a police station.
Application deadline: The application must be submitted within three months of having completed five years of legal and continuous residence.
