Permanent residence for a family member of an EU citizen

The permanent residence card for a family member of an EU citizen confirms the right of that family member (who is not an EU citizen) to reside and work in Spain indefinitely after five years of living together.

Who is it suitable for?
This status is intended for the closest relatives of an EU/EEA/Swiss citizen who do not hold EU citizenship and:
Have lived in Spain legally and continuously for 5 years on the basis of their previous residence card.
They maintain a family relationship with an EU citizen (or meet the conditions for retaining their right of residence).
  • Important note regarding Spanish nationals: Relatives of Spanish nationals may only use this scheme (EX-19) if the Spanish national has previously lived or worked in another EU country (so-called ‘reverse mobility’). Otherwise, the General Scheme (Modelo EX-24) applies.
Key legislation
  • Royal Decree 240/2007 (Real Decreto 240/2007) of 16 February (Articles 10–11) — regulates the rights of family members to permanent residence.
Requirements
A key requirement is proof of continuous and lawful residence.
Continuous residence: The total period of legal residence in Spain must be at least five years.
Permissible absences: Breaks in residence not exceeding two consecutive years do not affect the right to obtain permanent residence.
Retention of grounds: Maintaining family ties with an EU citizen or fulfilling the conditions for retaining status (for example, following the divorce or death of an EU citizen).
Validity: Issued for 10 years (and must be renewed upon expiry).
Ways to obtain permanent residence
A permanent residence card may be issued early in the following cases:
  • Pension: An EU citizen has reached retirement age and has worked in Spain for at least three years.
    Incapacity for work: An EU citizen has become permanently unable to work after two years of residence or employment.
    Death: Death of an EU citizen whilst working in Spain (provided that the family member has lived in the country for at least two years).

A valid passport or national identity card.
A copy of your current Resident Card (TIE).
Documents confirming the existence of a family relationship or connection.
Evidence that the EU citizen has retained their right of residence.
Proof of payment of the fee (Form 790): Code 052, section 2.7
Application procedure
The procedure is carried out at the Immigration Office (Oficina de Extranjería).
Application deadline: The application must be submitted within 3 months of having completed 5 years of legal and continuous residence.
Obtaining a TIE: Once approved, you must provide fingerprints to receive a new physical TIE card with ‘Permanente’ status, valid for 10 years. The card automatically entitles you to work.
