Spain Residence Permits 2026: Major Changes and New Rules of the Game

2025 has become a turning point for Spanish immigration law. A large-scale reform of the Foreigners' Regulations (Reglamento de Extranjería) has taken effect, streamlining legalisation for some while closing doors for others.
If you are planning a move, forget the old guides. Here is what is working right now.

1. The "Arraigo" Revolution: 2 Years Instead of 3

The biggest news is the reduction of the required period of irregular stay to obtain residency through Arraigo(settlement). Previously, one had to live in Spain "in the shadows" for 3 years. Now, it is only 2 years.
The new system categorizes settlement into 5 distinct types:
  • Arraigo Sociolaboral (Socio-Labor): 2 years in the country + a job contract (minimum 20 hours/week, with a salary not lower than the SMI/Minimum Wage).
  • Arraigo Social (Social): 2 years in the country + having resident relatives OR an integration report + proof of own funds.
  • Arraigo Socioformativo (Socio-Educational): Replacing the old "Arraigo para la Formación." It allows you to study and legally work for up to 30 hours per week.
  • Arraigo Familiar (Family): For parents of EU citizens and guardians. Granted immediately for 5 years.
  • Second Chance: For those who previously held a residence permit but lost it (no more than 2 years ago).
Note: For asylum seekers (asilo), the rules have tightened. It is now more difficult to convert time spent waiting for a refugee status decision into the years required for settlement.

2. The Golden Visa: End of an Era

There is somber news for real estate investors. The Golden Visa program for purchasing property over €500,000 has been officially phased out in 2025. Following the trend of addressing the housing crisis, Spain no longer grants residency simply for buying "square meters."
What should investors do? Consider the alternatives:
  • Digital Nomad Visa: If you have income from abroad.
  • Digital Nomad Residency: Income requirements have risen in 2025 (approx. €2,763/month for the main applicant), but this remains the fastest route.
  • Non-Lucrative Residence (No Lucrativa): If you have passive income and significant savings.

3. Students: Working and Studying Made Simpler

Spain has finally recognized the potential of international students.
  • Work Rights: A student estancia now automatically grants the right to work for up to 30 hours per week(previously lower and requiring separate permits).
  • Less Bureaucracy: Residence permits are now issued for the entire duration of the studies. You no longer need to visit Extranjería every year for renewals.
  • Post-Graduation: The transition from a student visa to a work permit has been significantly simplified.

4. Family and Reunification

Requirements for Family Reunification (Reagrupación familiar) have been eased:
  • Lower financial thresholds for those bringing children or elderly parents.
  • Faster procedures for relatives of Spanish citizens.

Summary: Easier, but Stricter

Spain has opened up for those who want to work and study but has simultaneously increased document scrutiny. Reducing the Arraigo period to 2 years is a massive opportunity for thousands to step out of the shadows.
However, any error in your application—from an incorrect criminal record certificate to an expired insurance policy—leads to an automatic rejection in 2025.
